Selling Fanart illegal?
I got another question regarding the selling of fanart which I thought is worth mentioning as well.
Most fanart is, once you sell it, a copyright infringement as you are using intellectual property of someone else to make money (aka: theft).
Many companies however, see fanart as free advertisement, tolerate it, and as a result, the trend of drawing and selling fanart at cons and online has become very popular.
But some companies do send out a cease and desist, and they are completely in the right when they do. If this happens, you should remove those works immediately.
Tv Tropes presents a decent ‘in a nutshell' list of incidents & which companies/creators do and don't hold a Strict Ban: ◘.
Its also important to note that there’s "a time and a place for everything” – Some companies specifically, don’t mind if fan works are being sold at conventions because its being done in a celebratory nature (and for a relatively short period of time) Others on the other-hand do. – Online stores & kickstarted projects are another story entirely.
You have free speech, you can still draw whatever you like and express yourself however you darn-well desire. But selling/producing with profit in mind is another thing completely. It’s very important to be cautious, be aware, do research and ask first, especially if its Fan-work done for something Indie. Stay alert peeps!
